A RESOLUTION STATING PERRY TOWNSHIP’S INTENT TO OPT-OUT OF H.B. 172

Chairman Dawson presented the following Resolution and moved its adoption:

A RESOLUTION STATING PERRY TOWNSHIP’S INTENT TO OPT-OUT OF H.B. 172 AND ESTABLISHING THE BAN ON DISCHARGING, IGNITING OR EXPLODING FIREWORKS IN PERRY TOWNSHIP.

WHEREAS, the Governor recently signed  H.B. 172, amending Ohio Revised Code 3743.45, effective July 1, 2022, allowing any person authorized to possess consumer grade fireworks to discharge, ignite or explode fireworks on their property, or if permitted, on another person’s property on certain designated days of the year; and

WHEREAS, H.B. 172 also provides that county, township, or municipal corporation may choose to restrict the days and times that a person may discharge consumer grade fireworks or may impose a complete ban on the discharge, ignition or explosion of consumer grade fireworks; and

WHEREAS, Perry Township will allow consumer grade fire works only on July 3, 4, and 5  2026  from 10:00 a.m. to 11:00 p.m.; and

WHEREAS, the Board of Trustees finds that a prohibition on the discharge of consumer grade fireworks will best protect the public’s right to the quiet enjoyment of their premises; and

WHEREAS, this Board finds that the unsafe and illegal discharge of fireworks poses a significant danger to the public and may cause serious injuries as well as significant property damage, especially in densely populated residential and business areas; and

WHEREAS, the Administration and Board of Trustees finds that it is in the best interests of the public to ban the discharge, ignition and explosion of fireworks otherwise permitted by H.B. 172 within Perry, Lake County, Ohio except consumer grade fire works only on July 3, 4, and 5,  2026 from 10:00 a.m. to 11:00 p.m.;

NOW, THEREFORE, BE IT RESOLVED by the Perry Township Board of Trustees, State of Ohio:

SECTION 1.  That Board of Trustees expressly opt-out of the provisions set forth in H.B. 172, and bans the discharge, igniting or exploding of fireworks within the Township of Perry, except consumer grade fire works may be used on July 3, 4, and 5, 2026 from 10:00 a.m. to 11:00 p.m.

SECTION 2.   It is found and determined that all formal actions of the Board of Trustees of Perry Township concerning and relating to the adoption of this Resolution were taken in an open meeting of the Board of Trustees of Perry Township and that all deliberations of this Board that resulted in those formal actions were in a meeting open to the public, in compliance with all legal requirements, including Section 121.22 of the Ohio Revised Code.
